NEW CONSOLIDATED MAIN AGREEMENT FOR THE BARGAINING COUNCIL FOR FOOD RETAIL, RESTAURANT, CATERING AND ALLIED TRADES – PRETORIA, RUSTENBURG AND OTHERS
On 11 February 2022, Government Gazette 45904 has been published, which contains the latest minimum wages and other conditions of employment for the Food Retail, Restaurant, Catering and Allied Trades. This agreement specifically relates to the magisterial districts of Pretoria, Rustenburg, Wonderboom (demarcated as Area A), as well as the magisterial districts of Brits, Bronkhorstspruit, Cullinan, Warmbaths and Witbank (dermarcated as Area B).
It is important to note that all employers that are associated wholly or mainly for the purpose of preparing, serving, or providing meals or refreshments (whether liquid or otherwise) or both such meals and refreshments in or from any establishment or part thereof, whether permanent, temporary, indoors or in the open air, would fall under the scope and jurisdiction of the Main Agreement.
For further certainty to employers, the Main Agreement is applicable to:
- Public restaurants, fish-and-chip shops, cafes, tearooms, roadhouses, and take-away food outlets.
- Places where meals or non-alcoholic drinks are served for consumption on the premises or are provided for consumption away from the premises.
- Places where aerated or mineral waters are supplied in glasses or other containers for consumption on the premises.
- Places that supply liquor in terms of a liquor license held.
This agreement is valid until 31 December 2022, after which it may be extended. Invictus Group will provide further updates in this regard.
Small employers, meaning employers that employ less than seven employees, and/or any other employer struggling to comply with provision of the Main Agreement may use the services of Invictus to assist in applying for exemption.
The below table sets out the minimum wages that are applicable for the period 21 February to 31 December 2022. It should be noted that there has also been an increase in the National Minimum Wage with effect from 1 March 2022, effectively increasing the minimum hourly rate to R23.19.
Employees that earn above the respective minimum wage set out in the table below, shall be entitled to a minimum increase of 5% with effect from 21 February. Employees that earn below the minimum wage should receive an adjustment to their rate to at least the minimum wage as detailed in the below table.
