The Congress of South African Trade Unions (COSATU) will embark on nationwide protest action across all nine provinces on Friday, the 7th of October 2022, to mark the World Day for Decent Work. The protest action is protected under Section 77 of the Labour Relations Act 66 of 1995. Accordingly, companies cannot dismiss employees for participating in such action.
All COSATU-affiliated members will be requested to join in on the protest action and other activities planned. Thus employers should prepare for adversely affected business operations on the day due to such action, where the employer has COSATU members in its employ.
Although employees who are members of COSATU cannot be disciplined for participating in the protest, employees can be disciplined in certain instances for misconduct committed during the protest action. Employees not members of such union being covered under the protection afforded for the protest action and who actively participate in the protest may face disciplinary action for failing to attend work without justification.
